‘Cyclovia Encinitas’ and new 2023 laws for CA bicyclists

An increase in traffic collisions for cyclists in the state and across the country prompted lawmakers to enact new bicycle laws in California.

ENCINITAS, Calif. – Cyclovia Encinitas took over part of Coast Highway 101 on Sunday, closing it to cars and leaving it wide open from D Street to J Street for people to walk, bike, skate or enjoy the open road in any way. chosen.

“Feels great, feels liberating, beautiful day,” said cyclist Mia Gonzales.

“Great day on Highway 101, nice to have it closed to all cars,” said Niels Vancastelle, who enjoyed the event with his wife and son.

The event gave people of all ages a chance to experience the 101 without cars and over a six-block stretch without lots of vendors and good food.

“It’s fantastic, we love the bikes, it’s good to be out in the sunshine,” said cyclist Chris Besaw.

“We just love being able to ride down here and see our neighbors and our community and be out and about on a beautiful sunny day,” said e-bike rider Eric Mosbrooker.

An increase in traffic collisions for cyclists in the state and across the country prompted lawmakers to introduce several new bicycle laws in California that took effect on January 1.

“I think drivers should be more aware of people on bikes and give them more room,” Hillcrest cyclist Toi Victoriano said.

One new law, AB 1909, now requires drivers to change lanes before passing a bicyclist if it is safe to do so. If no other lane is available, they must slow down and pass only when it is safe to do so.

“It’s a lot safer for cyclists because if cars come too close, you can have an accident,” Vancastelle said.

In the past, drivers only had to give cyclists 3 feet when passing, a rule that could be difficult to enforce. Cyclists we spoke to said that cars often cut it too close.

“We call it ‘getting the buzz,’ it doesn’t feel very good, it’s pretty scary,” Vancastelle said.

AB 1909 also allows Class 3 E-bikes, the fastest types that can travel up to 28 mph, to use bike lanes and hiking trails, reversing a previous statewide ban.

“I think it depends on the user, I hope the people who drive them are very responsible people, mature enough to drive it,” Gonzales said. “I think it’s a bit too fast on these tracks.”

Another new law, AB 1946, requires the California Highway Patrol to work with other agencies to implement training programs for e-bike users that include safety, emergency maneuvering skills and e-bike traffic rules.

“Maneuvering and riding this thing is completely different than riding a regular mountain or road bike, so it’s a great idea to educate people more about safety,” Mosbrooker said.

The training program should appear on the CHP website in September 2023.
