PROJECT NAME: Clark Avenue Apartments; CASE NUMBERS: MULTI-004609-2021, DR-004610-2021; BADJ-004611-2021, CDPNF-004612-2021, USE-005506-2022; PRESENTATION DATE: June 6, 2021; APPLICANT: Western National Properties; LOCATION: 662, 672 & 682 Clark Avenue and 556 Union Street (APNS: 256-171-13, 256-171-14, 256-171-15, 256-171-20, 256-171-21 and 256-171-24); PROJECT DESCRIPTION: Public Hearing to consider a Design Review Permit, Minor Use Permit Modification, Boundary Adjustment, and Coastal Development Permit for demolition of two existing residences, greenhouses, and accessory buildings, and construction of one residential development multi-family consisting of 199 residential apartments (159 market rate and 40 low-income units) including private amenities and common open space, grading, landscaping improvements, and use of one (1) temporary construction trailer, consolidate four lots on a legal lot and withdraw a prior right to the Minor Use Permit. ZONING/OVERLAP: The three northern parcels are zoned R-5; the three southern parcels are zoned R-3; and all parcels are located within the Residential Overlay 30 (R-30 OL), the Scenic/Visual Corridor Overlay, the Cultural/Natural Resources Overlay, and the Coastal Zone; ENVIRONMENTAL STATUS: The project is legally exempt from California Environmental Quality Act (CEQA) guidelines under Government Code Sections 65583.2(h) and (i), which states that if a housing development project is located on a designated ‘by right’ site, contains at least 20 percent of the units affordable to low-income households, and does not require subdivision, the City may only require project design review approval, and design review approval or will not constitute a “project” under CEQA. The Clark Avenue Apartment Project is legally exempt from CEQA because it is located in the R-30 overlay zone, which is designated for ‘by right’ approval of Encinitas Municipal Code Chapter 3 0.09 (Zoning Use Matrix Note 35); proposes that 40 of 199 units (20 percent), excluding additional units provided by a density bond, be affordable to low-income households; and does not require a subdivision.
